Terms of Service
Please read these Terms and Conditions carefully. They govern Your access to and use of HabitJar.
1. Definitions
Capitalized terms used in this document have the meanings given below, whether used in the singular or plural.
- Application / Service — the HabitJar mobile app made available by the Company for download and use on Your Device.
- Application Store — the marketplace through which You obtained the Application, i.e. the Apple App Store (Apple Inc.) or Google Play (Google LLC).
- Affiliate — an entity that controls, is controlled by, or is under common ownership or management with a party, “control” meaning holding 50% or more of that entity’s voting shares or equivalent decision-making authority.
- Country — the Republic of Korea.
- Company / We / Us / Our — SmallQuest Studio, the developer and operator of HabitJar.
- Device — a phone, tablet, computer, or similar piece of hardware capable of running the Application.
- Terms — this Terms of Service document, together forming the entire agreement between You and the Company regarding use of the Service.
- Third-party Service — any content, product, or feature supplied by a party other than the Company that is accessible from within, or linked from, the Service.
- You / Your — the individual using the Service, or, where relevant, the organization on whose behalf that individual acts.
2. Accepting These Terms
By downloading, installing, or otherwise using HabitJar, You confirm that You have read, understood, and agree to be bound by these Terms. If any part of them is unacceptable to You, please uninstall and discontinue use of the Application.
Use of the Service is also conditioned on Your acceptance of the Company’s Privacy Policy, which explains what information is collected through the Application and how it is handled. Please review it separately.
You must meet the minimum age required for online consent in Your country of residence to use HabitJar on Your own behalf — typically 13, though some countries set this higher. If You are younger than the age of legal majority where You live, a parent or legal guardian must supervise and authorize Your use of the Service on Your behalf.
3. “Lifetime” Purchases
If You buy a one-time “lifetime” unlock for HabitJar, that purchase licenses You to keep using the app’s features as they exist at the time You bought it. “Lifetime” describes how long the license itself lasts relative to HabitJar’s continued availability — it is not a commitment that the Company will operate HabitJar, or any server-side feature it depends on, forever.
The Company may modify, scale back, or shut down the Service at its own discretion and without advance notice. A lifetime purchase does not include a promise of future feature updates or ongoing server support beyond what is currently offered. If the Service is discontinued, any outstanding lifetime license ends at that point, and no refund will be issued for the unused remainder of it.
4. Third-Party Links and Services
HabitJar may reference or link out to websites or services the Company does not own or operate. We have no control over, and take no responsibility for, the content, availability, or privacy practices of those external destinations, and We are not liable for any loss arising from Your use of them. Please check the applicable terms and privacy policy before using any linked third-party service.
5. Suspension and Termination
The Company may suspend or terminate Your access to HabitJar at any time, without prior notice and without liability to You, for any reason — including, without limitation, a breach of these Terms. Once terminated, Your right to use the Service ends immediately, though this Section and Sections 6–9 and 12–15 will continue to apply.
6. Limitation of Liability
To the extent permitted by applicable law, the Company’s total liability to You for any claim arising out of or relating to Your use of HabitJar — however that claim is framed — and Your sole and exclusive remedy for any such claim, will not exceed the greater of (a) the amount You have paid the Company for the Service, or (b) 100 USD if You have not made any payment.
Neither the Company nor its suppliers will be liable for indirect, incidental, special, or consequential losses — including lost profits, lost data, or business interruption — connected to Your use of, or inability to use, HabitJar, even where such losses were foreseeable.
Where a jurisdiction does not permit excluding certain warranties or capping liability for incidental or consequential loss, the limitations above apply only to the extent that jurisdiction’s law allows.
7. Disclaimer of Warranties
HabitJar is provided on an “as is” and “as available” basis. To the fullest extent the law allows, the Company disclaims all warranties of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, title, or non-infringement.
The Company does not guarantee that HabitJar will be uninterrupted, error-free, secure, or compatible with every device or operating system version, that any information provided through it is accurate, reliable, or current, or that any defect will be corrected. Nor do We warrant that HabitJar, its servers, or any communication sent from or on behalf of the Company is free of viruses or other harmful components. Some jurisdictions restrict how far such disclaimers can go with respect to consumer rights; where that is the case, this Section applies only to the extent permitted there.
8. Governing Law
These Terms, and any dispute arising from Your use of HabitJar, are governed by the laws of the Republic of Korea, without regard to its conflict-of-law rules. This choice of governing law does not deprive You of any protection guaranteed by a mandatory consumer-protection law that would otherwise apply and cannot be waived by agreement — including, where applicable, under Korean consumer protection statutes or the law of Your own country of residence. Your use of the Application may also be subject to other local, state, national, or international laws.
9. Resolving Disputes
If a disagreement arises over the Service, please contact the Company first so We can try to resolve it directly before pursuing any other remedy.
10. Users in the European Union
If You are a consumer resident in the European Union, You continue to benefit from any mandatory protection granted by the law of Your country of residence, regardless of the governing-law choice above.
11. Export Control and Sanctions
By using HabitJar, You confirm that You are not located in a country subject to comprehensive trade sanctions, and that You are not listed on any government list of restricted or prohibited parties under applicable export control or sanctions law.
12. Severability
If a court finds any provision of these Terms unenforceable, that provision will be narrowed only as much as needed to make it enforceable while preserving its intent, and the remaining provisions stay in full effect.
13. No Waiver
If the Company does not immediately act on a breach or enforce a particular right, that does not mean the right has been given up — We may still rely on it later, and overlooking one breach does not excuse any breach that follows.
14. Updates to These Terms
The Company may update these Terms from time to time. Where a change is significant, We will make reasonable efforts to notify You at least 30 days before it takes effect. Continuing to use HabitJar after an update takes effect means You accept the revised Terms; if You do not, please stop using the Service.
